Newborn Photography Contract Template
The session fee of $75.00 is due upon booking and is non-refundable. This fee secures your session booking and the current pricing structure. The session fee includes:
- Session styling consultation
- 2-4 hours of professionally styled photography by an experienced photographer
- Facebook sneak peeks
- Access to a vast range of Newborn props and/or Maternity gowns sourced locally and internationally
- Professional and custom retouching/editing of your images
- Online proofing gallery of 30-50 images available within 2 weeks of your session that is password protected
* The session fee does not include Digital files or products.
In the event of an illness or misadventure, please call as soon as possible to reschedule. The photography company maintains the right to reschedule at any time should it become necessary but will do our utmost to negotiate a mutually acceptable rebooking. The request must be made no later than 24 hours prior to your scheduled booking.
Cameras, phone cameras, and video are not permitted during any session unless approved by the Photography Company.
The Photography Company does not deliver images that have not been edited to the highest professional standard and to the style of our portfolio.
The Photography Company will not start any gallery retouching/editing on finalised images until all payments have been finalised. Full payment of your chosen package must be paid within 14 days of when your online gallery was issued.
Once your gallery has been issued, the selection of images must be finalised within 14 days. The Photography Company will provide you with assistance if required in choosing your images.
The Photography Company retains the copyright on all images and reserves the right to use the images for advertising, display, publication, social media and/or other purposes for our portfolio. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the photographer in the event of litigation arising out of such use. Digital files and previews remain the exclusive property of the Photography Company. Under no circumstances, can a client use these images for profit, commercial endeavours, professional display, or in competition. Copying, snapshotting, saving or scanning images from the client's gallery, the Photography Company website, or social media sites is considered stealing, regardless of the intent for use. If client steals images via any method listed above, or any other method, the client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. SHARING images and links on the web from its main source is highly acceptable and encouraged to show family and friends your beautiful images.
The client is aware if they choose to print their images through a personally chosen lab that the quality of the end result print of the digital files delivered is not under the control of the photographer, and frees the Photography Company from any liability for any potential claims whatsoever based upon discoloration in the end result.
If the Photography Company cannot fulfill this contract due to fire or other causality, or beyond the control of the photographer, or due to the photographer’s illness or emergency, then the photographer shall return any deposit or sitting fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply if the event of photographic materials is damaged without fault on the photographer. The client releases any and all employees of the Photography Company from all liabilities, claims, and damages that may result from any accidents or incidents that could have been prevented that may happen during the session.
The Photography Company is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Having a newborn is pretty exciting and at the same time very challenging. It is important to capture the moments of the newborn baby because this will be treasured deeply by the parents.
As a photography company, this contract will definitely enhance your signing process. After closing a deal with the parents, you can give them this contract for them to sign. After that, you can ask for the expected date of delivery of the mother so that you can set an estimated date range for the session in the hospital after the baby was born.
